Persimmon Terms of Service

Service Name: Persimmon (an AI-enabled research exploration application for iOS)
By accessing or using Persimmon, you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy (linked here). If you do not agree, you must not use the service.
1. Definitions
- Company refers to Momenta Lab LLC, a Texas company.
- Service refers to Persimmon, an AI-enabled research exploration application for iOS.
- Persimmon Cloud refers to the optional cloud-based account feature that allows users to sync preferences across devices.
- AI Summaries are condensed interpretations of arXiv/OSF content generated by the Service’s machine learning models.
- arXiv is the open-access archive of scientific research hosted by Cornell University.
- OSF (Open Science Framework) is a free, open-source platform for managing, sharing, and publishing research projects, hosted by the Center for Open Science. This includes OSF repositories and SocArXiv (the social sciences preprint server).
2. Acceptance of Terms
You must be at least 13 years old (or the age of majority in your jurisdiction) to use Persimmon. By using the Service or creating a Persimmon Cloud account, you confirm your agreement to these Terms and the Privacy Policy.
3. Permitted Use
You may use Persimmon to:
- Search, browse, and save arXiv submissions.
- Generate AI summaries of scientific content for educational, research, or non-commercial purposes.
- Customize your experience by reporting your scientific background or interests.
- Create an optional Persimmon Cloud account to sync preferences across devices.
Prohibited Use:
You agree not to:
- Scrape, reproduce, or redistribute arXiv content in bulk without compliance with arXiv’s robots.txt and API Terms of Service.
- Scrape, reproduce, or redistribute OSF/SocArXiv content in bulk without compliance with OSF’s API Terms of Service.
- Use AI summaries for commercial redistribution, including reselling or repackaging.
- Modify, reverse-engineer, or create derivative works of the Service’s backend systems.
- Use the Service to distribute harmful, illegal, or unethical content.
4. AI-Generated Content Disclaimer
- Accuracy: AI summaries are for informational purposes only. They may contain errors, omissions, or misinterpretations due to the nature of AI systems. The Company does not guarantee their correctness or completeness.
- No Endorsement: The Service does not endorse, verify, or take responsibility for the scientific validity of arXiv/OSF content or its AI-derived interpretations.
- Ethical Use: Users must not misuse AI summaries (e.g., for plagiarism, misinformation, or deceptive practices).
5. Intellectual Property
- arXiv Content: All arXiv submissions are the intellectual property of their respective authors. The Service provides access to such content in accordance with arXiv’s Terms of Use.
- OSF Content: All OSF (Open Science Framework) submissions are the intellectual property of their respective authors. The Service provides access to such content in accordance with OSF’s Terms of Use.
- Company Property: The Service, including its AI models, user interface, and proprietary code, is owned by Momenta Lab LLC. You may not copy, modify, or distribute these without explicit permission.
- User Content: Data you generate (e.g., notes, saved preferences, interests) remains yours. If you use Persimmon Cloud, you grant Momenta Lab LLC a non-exclusive, royalty-free license to store and sync such data across your devices.
6. Account Registration and Persimmon Cloud
- Optional Account: Creating a Persimmon Cloud account is entirely optional. All core functionality of Persimmon works without an account.
- Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
- Authentication Methods: You may create an account using email/password or through OAuth providers (Apple Sign-In, GitHub Sign-In), subject to their respective terms.
- Account Deletion: You may delete your Persimmon Cloud account at any time through the app settings. Upon deletion, all associated data will be permanently removed from our systems with no backup retention.
7. Data Security
The Company implements reasonable technical and organizational security measures to protect your data. For Persimmon Cloud users, this includes encryption in transit (HTTPS/TLS) and encryption at rest. However, no system is 100% secure, and we cannot guarantee absolute protection. You are responsible for maintaining the confidentiality of your account credentials.
8. Compliance with arXiv Policies
The Service adheres to arXiv’s robots.txt and API usage guidelines. Users must:
- Attribute arXiv authors and submissions appropriately when sharing content.
- Comply with arXiv’s Terms of Use when accessing or redistributing material.
9. Privacy Policy
The Service collects and processes user data in accordance with our Privacy Policy. Key points include:
- Core functionality works entirely on-device with no data collection.
- Persimmon Cloud (optional) stores email, password hash, and user preferences for syncing across devices.
- We never sell your personal data to third parties.
- Data is only used by processors (e.g., Supabase, AWS) for business purposes, not advertising or marketing without explicit consent.
10. Future Premium Features
The Company may introduce advanced features behind a subscription or paywall in the future. Important:
- All core functionality will remain free and accessible without an account.
- Persimmon Cloud (for syncing) will remain free.
- Premium features will only be accessible with a Persimmon Cloud account.
- You will be clearly informed before any feature requires payment.
- Payment processing will be handled by third-party providers (e.g., Apple App Store, Stripe) subject to their own terms.
11. Limitations of Liability
- No Warranty: The Service is provided “as-is” without warranties of any kind, including for accuracy, reliability, or non-interruption.
- Exclusion of Damages: To the fullest extent permitted by law, Momenta Lab LLC shall not be liable for indirect, incidental, or consequential damages arising from use of the Service.
12. Termination
- By You: You may stop using Persimmon at any time. If you have a Persimmon Cloud account, you may delete it through the app settings, which will permanently remove all associated data.
- By Us: The Company may suspend or terminate your Persimmon Cloud account if you violate these Terms. Core app functionality (without an account) cannot be terminated, but the services behind Persimmon’s functionality can use IP information to rate-limit or ban users at their own discretion.
13. Governing Law and Dispute Resolution
- Governing Law: These Terms are governed by the laws of Texas, USA.
- Dispute Resolution: If a dispute arises, you agree to first attempt to resolve it through informal negotiation. If unresolved, disputes shall be resolved in the courts of Texas without regard to conflict-of-law principles.
14. Modifications
The Company reserves the right to update these Terms at any time. Changes will be posted here with an updated “Last Updated” date. Continued use of the Service constitutes acceptance of the new Terms.
